RULES AND CONDITIONS OF ENTRY
 
1. Organisation
XXXX 1.1 The organising authority will be the Royal Cornwall Yacht Club.
2. The Rules
  2.1. The event will be governed by these rules, the decisions of the Jury, the International Rules for the Prevention of Collision at Sea, subsequent amendments to these rules and any sailing instructions that may be issued.
  2.2. The Royal Cornwall Yacht Club will establish a Jury consisting of not less than three persons to decide matters of dispute relating to these rules. The Jury shall have power to impose such penalties or to award such redress as it sees fit.
3. The Event
  3.1. The race is open to any type of sailing yacht with a length overall (LOA) from 29ft to 61ft sailed either single-handed or two-handed.
  3.2. The race will start from Falmouth on Saturday 7th June 2003 at 1500 BST.
  3.3. The first leg will be to Ponta Delgada, Island of São Miguel, Azores, leaving the Manacles buoy to starboard. The finish line will be a line passing through the light at the end of the harbour breakwater at Ponta Delgada and a signal mast on the clubhouse. Yachts shall finish by crossing the line in a westerly direction.
  3.4. The second leg will start from Ponta Delgada on Monday 23rd June 2003 unless a slow first leg necessitates a postponement.
  3.5. The second leg will be from Ponta Delgada to Falmouth, leaving the Manacles buoy to port. The finish line will be a line to the East of Black Rock Buoy passing through Black Rock Buoy and a flagstaff on the shore below Pendennis Castle, bearing 270°T. Yachts shall finish by crossing the line in a northerly direction.
  3.6. The total distance is approximately 2400 nautical miles.
  3.7. No crew member may start the second leg less than 48 hours from the time at which he or she finished the first leg.
  3.8. The elapsed time of each yacht will be taken from the actual start time of the class in which it is racing. Corrected times will be based on IRC Handicaps for monohulls and on MOCRA Handicaps for multihulls.
4. Qualification
  4.1. Before an entry is confirmed the skipper must have completed a non-stop qualifying passage of not less than 500nm in the yacht in which he or she will compete in the race. When a yacht is to be sailed single-handed in the race, the qualifying passage must be completed single-handed. When a yacht is to be sailed two-handed in the race, the qualifying passage must be completed either by the skipper alone or by the skipper and one other person who shall be his nominated crew.
  4.2. In the case of an entry with a change of crew for the second leg it is not necessary for the skipper to qualify with each crew member.
  4.3. Crew members who have not taken part in a qualifying passage must have considerable offshore cruising or racing experience. Evidence of this experience must be submitted to the committee.
  4.4. The qualifying passage shall be completed after January 1st 2001.
  4.5. The distance sailed shall be measured as the shortest navigable distance between the start, finish and not more than TWO other points. The majority of the passage shall have been out of sight of land or of fixed points (lights, buoys etc).
  4.6. Evidence of qualification shall be submitted to the Royal Cornwall Yacht Club no later than Thursday May 1st 2003. Evidence shall include the original log of the passage together with an English translation if the log was not originally in English. The evidence will be examined by the organising committee. Their decision as to whether or not the evidence submitted is acceptable shall be final.
  4.7. The Race Committee reserves the right to waive or to modify the requirement for qualification in exceptional circumstances. Those who have completed similar two-handed races or passages in the yacht in which he or she will compete in the Azab Race may apply for a waiver.
5. Classes
  5.1. Yachts will be divided into the following classes:-
  XX 5.1.1. Class 1 Monohulls with an IRC handicap TCF below 0.900
    5.1.2. Class 2 Monohulls with an IRC handicap TCF from 0.900 to 0.949 inclusive.
    5.1.3. Class 3 Monohulls with an IRC handicap TCF from 0.950 to 0.999 inclusive
    5.1.4. Class 4 Monohulls with an IRC handicap TCF of 1.000 and over
    5.1.5. Class 5 Multihulls
  5.2. The organisers reserve the right to amend the classes shown above. Any amendment will be announced no later than the pre-race briefing on Friday 6th June 2003
6. ORC Special Regulations
  6.1. Skippers will be required to certify that their yachts comply with Category 1 of the ORC Special Regulations governing Offshore Racing current at the time of the start. Except that:
  6.2. ABS approval is not required.
  6.3. In addition to the ORC requirements for numbers on sails, the yacht’s sail number shall be marked or affixed on a flat area of the deck or cabin top in figures as large as the space allows in a colour that contrasts with that of the deck, so that it may be clearly seen from the air.
  6.4. A "Grab Bag", with contents as recommended in ORC Special Regulations is mandatory.
  6.5. N.B: Copies of ORC Special Regulations are available from the RYA or can be downloaded from www.orc.org
7. Handicaps
  7.1. Entrants must submit a copy of their 2003 IRC or MOCRA Handicap Certificate to RCYC no later than 1st May 2003.
  7.2. Each yacht shall race under the handicap current for that yacht at 1200 on Saturday June 7th 2003.
8. General
  8.1. All types of self-steering device are permitted.
  8.2. Yachts shall not take on fuel or stores of any kind, nor shall they receive any outside assistance, escort or be escorted by another competitor or arrange for any other escort, between starting and finishing a leg.
  8.3. Yachts may be propelled using the manpower of the crew. An internal combustion engine, which may be the yacht's auxiliary engine, may be used to charge batteries and drive equipment such as bilge pumps, water ballast pumps and windlasses, but not to handle sails. If the engine is used to propel the yacht at any time during the race, the circumstances must be recorded in the yacht's log and a declaration describing the circumstances must be made to the race committee on arrival at the finish of the leg.
  8.4. The LOA measurement shall be the length overall of the hull excluding bowsprit, stem fittings, pulpit, pushpit, rudder, skeg, etc.
  8.5. Yachts may sail one leg single-handed and the other leg two-handed.
  8.6. The Skipper and/or crew may change in Ponta Delgada.
9. Entries
  9.1. The Royal Cornwall Yacht Club reserves the right to decline to accept any entry at its absolute discretion and without giving reasons.
  9.2. The number of entries accepted will be restricted to 70 and the entry list will be closed as soon as 70 entries have been received. The Race Committee reserves the right to open a short waiting list. All entries will be dealt with strictly in the order in which they are received.
  9.3. Entry forms are available from RCYC or from the RCYC website, www.royalcornwallyachtclub.org
  9.4. Entries must be submitted on the official entry form and must be accompanied by a non-returnable deposit of £100.
  9.5. The entry fee will be £360.
  9.6. The closing date for entries will be Monday 31st March 2003 by which date any outstanding balance of the entry fee must have been paid.

  9.8. Passport or larger photographs of the skipper and crew and a photograph of the yacht must be submitted for safety and publicity purposes by 31st March 2003. Colour or black and white prints are acceptable. (Laser photocopies are NOT acceptable, as they cannot easily be reproduced by printers) Digital images may also be accepted - please consult the race committee.
10. Registration
  10.1. Competitors must report to the race office at the RCYC not later than 1100 on Friday 6th June 2003. They will be required to sign a declaration of compliance with all safety regulations and confirming possession of valid third party liability insurance with a minimum cover of £1,000,000.
  10.2. Competitors shall submit a completed Coastguard Form CG66
11. Race Briefing
  11.1. A briefing conference will be held at 1200 on Friday 6th June 2003 in the RCYC clubhouse. All competitors are expected to attend.
  11.2. A similar conference will be held in Ponta Delgada before the start of the return leg at a time and place to be announced.
12. Sailing Instructions
  12.1. Sailing instructions will be issued by 1st May 2003; amendments to the sailing instructions may be issued.
13. Declarations and Penalties
  13.1. Within 12 hours of finishing each leg the skipper, and where appropriate the crew, must sign and hand to a nominated representative of the organisers a declaration stating:
    13.1.1. That the race has been sailed in accordance with the rules and sailing instructions - or, if such a declaration cannot be made, a detailed statement of the circumstances which prevent the declaration being made.
    13.1.2. The noon (GMT) position of the yacht on each day that it was at sea.
    13.1.3. The time at which it finished the leg concerned.
  13.2. In exceptional circumstances, and after the committee has been informed, the time limit for submission of the declaration may be extended to 48 hours.
  13.3. A yacht’s finishing time shall be taken as its declared finishing time unless the Jury decides to amend it as provided below.
  13.4. Failure to comply with the rules and any amendments or additions shall render the yacht liable to disqualification from that leg of the race or to the imposition of a time penalty by the Jury. The Jury will impose time penalties to be added to the yacht's elapsed time for starting prematurely.
14. Aids to Navigation
  14.1. All types of radio and electronic aid to navigation and weather data are permitted but pre-arranged radio transmissions for the use of individual competitors are prohibited. Transmissions between competitors and the Race Committee are permitted and encouraged for the purpose of relaying the location and progress of competitors.
15. Finishing
  15.1. To qualify as a finisher a yacht must finish at Falmouth not later than 31st July 2003.
16. Perpetual Trophies and Prizes
  16.1 For the shortest aggregate elapsed time (line honours).
    Any class     The Henri-Lloyd Challenge Trophy
  16.2 For the shortest aggregate corrected time.
    Class 1      The Mike Allum Trophy
    Class 2      The Prince of Wales Cup
    Class 3      The Borough Members Cup
    Class 4      The Warington Smyth Bowl
    Class 5      The Sandfly Salver
    The RCYC Tankard to the yacht in any class which has been sailed single-handed on both legs of the race.
    The Visick Perpetual Trophy to the yacht in any class, the crew of which must be related
  16.3 For the shortest corrected time on the return leg.
    Class 1      The Hotels Association Trophy
    Class 2      The Falmouth Town Salver
    Class 3      The Falmouth Yacht Marina Trophy
    Class 4      The Chamber of Commerce Trophy
    Class 5      The MOCRA Trophy
  16.4 The John & Sally May Trophy to the skipper and crew who are judged by the competitors to have contributed the most to the Corinthian spirit of the race.
  16.5 The skipper and crew of the yacht with the shortest aggregate corrected time in each class will receive a prize.
  16.6 The skipper and crew of the yacht with the second shortest aggregate corrected time in each class with five or more starters will receive a prize.
  16.7 The skipper and crew of the yacht with the third shortest aggregate corrected time in each class with seven or more starters will receive a prize.
  16.8 Where a skipper or crew change has taken place in Ponta Delgada only two prizes will be awarded.
  16.9 Additional prizes may be awarded.
  16.10 Prizes will be presented in September 2003 on the first Saturday of the Southampton Boat Show at a place to be announced, convenient to the Show.
17. Liability
  17.1. The safety of a yacht and her entire management including insurance shall be the sole responsibility of the owner / competitor racing the yacht who must ensure that the yacht and crew are adequate to face the conditions that may arise in the course of the race. The establishment of these rules in no way limits or reduces the absolute responsibility of the owner / competitor for his crew, his yacht and the management thereof. The race organisers shall not be responsible for any loss, damage, death or personal injury howsoever caused to the owner / competitor, his skipper or crew, as a result of their taking part in the race. Moreover every owner / competitor warrants the suitability of his yacht for the race.
  17.2. If any provision of this notice is invalid, illegal or incapable of being enforced by reason of any rule of law or public policy all other provisions of this notice shall nevertheless remain in full force and effect and no provision shall be deemed dependant on any other provision.
  17.3. Nothing in this notice shall be deemed to constitute a partnership between the Royal Cornwall Yacht Club and each and any entrant or constitute one the agent of the other for any purpose.
  17.4. Clause headings are inserted in this notice for ease of reference only and do not form part of this notice for the purposes of interpretational construction.
18. Disputes
  18.1. The Jury will meet in Falmouth on 20th August 2003 to hear representations from any competitor who believes that his finishing position has been materially affected by any act or omission of the Royal Cornwall Yacht Club or of any other competitor and to hear representations from the Royal Cornwall Yacht Club if it believes that any competitor has failed to comply with these rules. The meeting will be conducted entirely in English and both verbal and written submissions may be made.
  18.2. Any competitor who wishes to make representation to the Jury must give notice in writing setting out full details of the case to be made. The notice must be received at the Royal Cornwall Yacht Club no later than 1st August 2003.
  18.3. Written notice of the proposed business of the Jury shall be sent by post to the registered address of each involved person not less than two weeks before the meeting.
  18.4. The Jury will hear the Yacht Club and any yacht whose position might be affected by the decision of the Jury.
  18.5. Except as to protests under the provisions of rules 18.1, 18.2, 18.3 and 18.4 above any dispute or difference in connection with this notice and/or any agreement between an entrant and the Royal Cornwall Yacht Club shall be referred to and determined by a sole arbitrator ("the Arbitrator") such arbitration to be held in London and the Arbitrator shall be appointed by agreement between the parties or in default of agreement by the President for the time being of the Law Society of England or his appointee. The procedure to be followed shall be agreed by the parties or in default of agreement by the arbitrator. In the event of default by either party in respect of any procedural order made by the Arbitrator the Arbitrator shall have power to proceed with the arbitration in the absence of that party and deliver his award.
19. Data Protection Act
  19.1. Application for entry will be deemed to constitute consent to the holding of relevant personal data for the purposes of the Data Protection Act 1984.
